Goodwin Auctions Pty Ltd — Terms & Conditions of Sale

Effective Date: 1st October 2025

By registering to bid or purchasing from Goodwin Auctions (ABN 14 688 322 045), you agree to the following Terms & Conditions. These apply to all buyers, whether bidding online, in person, by absentee, or telephone.

1. Registration & Bidding

1.1. All bidders must register with accurate contact details and accept these Terms before placing bids.
1.2. Goodwin Auctions reserves the right to refuse or cancel registration or bidding privileges at any time.
1.3. The highest bidder at the fall of the hammer (or close of online bidding) is deemed the purchaser.
1.4. No bid may be withdrawn once placed.
1.5. Bidders are responsible for ensuring they understand the lot they are bidding on, including all descriptions and images provided.

2. Buyer's Premium

2.1. A Buyer's Premium of 22% inc GST is added to the final hammer price of all lots.
2.2. This fee is payable by the buyer in addition to the bid amount.

3. Payment Terms

3.1. All purchases must be paid within 3 business days of the auction closing.
3.2. Accepted payment methods include:

• Bank transfer (preferred)
• Credit/debit card (surcharges may apply)
• Cash (in person only) – For purchases under $5000
  3.3. Ownership of goods does not transfer to the buyer until full payment has been received and cleared.
  3.4. Failure to pay may result in the cancellation of your purchase and the item being resold. Legal action may also be taken, and bidding privileges may be revoked.

4. Goods & Descriptions

4.1. All items are sold “as is, where is” without warranty or guarantee unless stated otherwise.
4.2. While all descriptions, images, and condition reports are made in good faith, no responsibility is accepted for errors or omissions.
4.3. Buyers are strongly encouraged to inspect lots in person or contact us for condition reports before bidding.
4.4. No refunds or returns are accepted except as required by Australian Consumer Law.

5. Collection & Shipping

5.1. Items must be collected within 7 days of the auction unless prior arrangements are made.
5.2. Storage fees may apply for late collection.
5.3. We offer shipping via Australia Post Platinum Express Post:

• Free shipping for purchases over $1,000
• $19.90 flat-rate shipping for items under $1,000
  5.4. Shipping includes tracking and signature on delivery.
  5.5. Risk passes to the buyer once the item is collected or dispatched.
  5.6. We are not liable for loss or damage during transit. Insurance is available upon request.

6. Uncollected Items

6.1. Any item not collected or shipped within 30 days may be deemed abandoned unless prior written agreement is made.
6.2. Abandoned items may be resold, and any proceeds will be retained by Goodwin Auctions to cover storage, handling, and resale costs.

7. Returns & Disputes

7.1. All sales are final. Returns are not accepted unless the item is materially misdescribed in breach of Australian Consumer Law.
7.2. Any dispute must be raised in writing within 5 business days of receiving the item.
7.3. Goodwin Auctions reserves the right to resolve any disputes at its sole discretion, which may include a refund, return, or replacement.

8. Limitation of Liability

8.1. To the extent permitted by law, Goodwin Auctions shall not be liable for any indirect, incidental, or consequential damages arising from the purchase or use of any lot.
8.2. Our liability is limited to the amount paid for the item in question.

9. Privacy Policy

9.1. All personal information is collected and handled in accordance with the Privacy Act 1988 (Cth).
9.2. Your information will not be shared with third parties except as required to process payments, arrange shipping, or comply with legal obligations.

10. General Terms

10.1. These Terms are governed by the laws of the State of New South Wales.
10.2. Any legal proceedings shall be held in the courts of that state.
10.3. Goodwin Auctions reserves the right to update or amend these Terms at any time.
10.4. Continued bidding or use of our services constitutes acceptance of any updated Terms.
